The Public Gambling Act states categorically that ‘nothing in this Act shall apply to games of mere skill wherever played’ i.e. live poker room or elsewhere. The Indian Gaming Act’s Section 11 exonerated poker from being subjected to any penal provisions of the 2 laws governing gambling which were framed way back in 1957. A poker tournament is a competition in which success foes the way of those who exert the leverage of their skills. It is undeniable that the element of chance is inherent in the game but mere skills can only drive one home. Further, on 27th July 2007, the Bangalore High Court had decreed that organizing live poker does not come under the purview of Karnataka Police Act 1963 or 1986s License of Controlling of Places of Public Amusements.
